Insighter: AI CRO & AB Testing ("Insighter," "the App," "we," "us," or "our") is developed and operated by CMK Technologies. The App provides AI-powered conversion rate optimization analysis, A/B testing, and theme section management tools (the "Service") to merchants who use Shopify to power their stores.

This Privacy Policy describes how personal information is collected, used, and shared when you install or use the App in connection with your Shopify-supported store.

By installing or using the App, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree, do not install or use the App.

1. Personal Information We Collect

Information from Shopify

When you install the App, we access certain information from your Shopify account as permitted by the access scopes you grant:

• Theme file access — to read, upload, update, and duplicate theme files and assets as required to provide A/B testing, section management, and CRO features.

• Store information — store name, domain, Shopify plan, currency, and timezone.

• Storefront data — product, collection, and page data as needed to perform page analysis and generate testing recommendations.

• Online store navigation and preferences — to understand store structure for analysis purposes.

Information from Merchants

• Account information: name, email address, store URL, and billing information as provided through Shopify or directly to us.

• App usage data: interactions with the App dashboard, feature usage, configuration preferences, test setups, and analysis requests.

Information Collected Automatically

• Analytics and performance data: visitor traffic data processed through our analytics infrastructure for the purpose of A/B test measurement, including page views, conversion events, variant assignments, and session identifiers.

• Technical data: IP address, browser type, device type, operating system, referring URLs, and timestamp data collected via cookies, log files, and similar technologies for the purpose of delivering and improving the Service.

Storefront Visitor Data

When a merchant activates A/B testing features, the App may process limited data about the merchant's storefront visitors for the sole purpose of measuring test performance. This data includes:

• A randomly assigned variant identifier (cookie-based).

• Page view and conversion event data tied to the test.

• Device type and browser information for segmentation.

We do not collect names, email addresses, payment information, or any personally identifiable information from storefront visitors beyond what is described above. We do not build visitor profiles, sell visitor data, or use visitor data for any purpose other than providing A/B test results to the merchant.

2. How We Use Your Information

We use the information we collect to:

• Provide, maintain, and improve the Service, including AI-powered page analysis, A/B test creation and management, and section/theme management.

• Measure and report A/B test results to merchants.

• Authenticate users and secure the App.

• Communicate with you regarding support, updates, and service-related notices.

• Monitor App performance, diagnose technical issues, and prevent abuse.

• Comply with legal obligations and enforce our terms.

We do not:

• Sell personal information to third parties.

• Use merchant or visitor data for advertising or marketing purposes unrelated to the App.

• Use storefront visitor data for any purpose other than A/B test measurement on behalf of the merchant who activated the test.

3. How We Share Your Information

We may share personal information with the following categories of third parties, solely to the extent necessary to provide the Service:

• Shopify — as required to operate within the Shopify platform and APIs.

• Cloud infrastructure and hosting providers — for data storage, processing, and delivery.

• Analytics and event processing providers — for A/B test data collection and measurement.

• AI service providers — for processing page analysis requests. Page content sent to AI providers is treated as transient and is not stored by those providers beyond the processing session, subject to their own data processing agreements.

We may also disclose information if required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of CMK Technologies, our users, or the public.

4. Data Retention

• Merchant data is retained while your account is active and for a reasonable period afterward to comply with legal obligations and resolve disputes.

• A/B test data is retained for the duration of the test and for a reasonable period after completion to allow the merchant to review results. Merchants may request deletion of test data at any time.

• Storefront visitor data used for A/B testing is anonymized or deleted within 90 days of test completion unless the merchant requests earlier deletion.

If you uninstall the App, we will delete or anonymize your personal information within 30 days, except where retention is required for legal compliance, fraud prevention, or legitimate business purposes.

You may request deletion of your data at any time by contacting us.

5. Cookies and Tracking Technologies

The App uses cookies and similar technologies for the following purposes:

• Essential cookies — to authenticate merchants and maintain session state within the App dashboard.

• A/B test assignment cookies — to assign and persist variant assignments for storefront visitors participating in active tests. These cookies are first-party cookies set on the merchant's domain and contain only a variant identifier.

• Analytics cookies — to measure App performance and usage.

We do not use third-party advertising cookies or cross-site tracking.

6. Data Security

We implement commercially reasonable technical and organizational measures to protect personal information against unauthorized access, alteration, disclosure, or destruction. These include encryption in transit (TLS), access controls, and secure infrastructure practices.

However, no method of electronic transmission or storage is completely secure. We cannot guarantee absolute security, and you acknowledge that you provide personal information at your own risk.

7. International Data Transfers

Your information may be transferred to and processed in countries other than your own, including Denmark, the United States, and other countries where our service providers operate. By using the App, you consent to such transfers. We take steps to ensure that your information receives an adequate level of protection in the jurisdictions in which we process it.

8. Your Rights

Depending on your jurisdiction, you may have the right to:

• Access the personal information we hold about you.

• Request correction of inaccurate information.

• Request deletion of your personal information.

9. Merchant Responsibilities

As a Shopify merchant using the App, you are responsible for:

• Providing appropriate notice and obtaining any required consent from your storefront visitors regarding cookies and data collection related to A/B testing.

• Ensuring that any content, claims, or test variants you create or publish through the App comply with applicable advertising, consumer protection, and other laws.

We provide the tools; the merchant is responsible for how they are used.

10. Third-Party Services

The App integrates with Shopify and may interact with third-party services as described in this policy. We are not responsible for the privacy practices of Shopify or any other third-party service. We encourage you to review their respective privacy policies.

11. Children's Privacy

The App is not directed to individuals under the age of 16. We do not knowingly collect personal information from children. If we learn that we have collected information from a child under 16, we will delete it promptly.

12. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes to our practices, the App, or legal requirements. We will notify merchants of material changes through the App dashboard or by email. Continued use of the App after changes constitutes acceptance of the updated policy.

These Terms of Service ("Terms") govern your access to and use of Insighter: AI CRO & AB Testing ("Insighter," "the App," "we," "us," or "our"), developed and operated by CMK Technologies. The App provides AI-powered conversion rate optimization analysis, A/B testing, and theme section management tools (the "Service") to merchants who use Shopify to power their stores.

By installing, accessing, or using the App, you ("Merchant," "you," or "your") agree to be bound by these Terms. If you do not agree, do not install or use the App.

1. Service Description

Insighter provides the following features through the Shopify platform:

• AI-powered page and UX analysis with conversion optimization suggestions.

• A/B testing tools including AI-generated test variants and theme/page testing.

• Theme section management including section creation and customization.

• Analytics and reporting on test performance.

The specific features available to you depend on your subscription plan.

2. Eligibility and Account

You must have an active Shopify store to use the App. By installing the App, you represent that you have the authority to bind the store owner to these Terms. You are responsible for maintaining the security of your Shopify account and for all activity that occurs under your account.

3. Subscription and Billing

• The App is offered through subscription plans with pricing as displayed in the Shopify App Store or within the App at the time of subscription.

• All charges are billed through Shopify's billing system in accordance with Shopify's terms.

• We reserve the right to change pricing at any time. Price changes will take effect at the start of your next billing cycle. We will provide reasonable advance notice of pricing changes.

• Free trials, if offered, may be subject to limitations. We reserve the right to modify or discontinue free trials at any time.

• No refunds are provided for partial billing periods, except as required by applicable law.

  
  

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations.

• Use the App to create, distribute, or test content that is fraudulent, misleading, defamatory, obscene, or otherwise objectionable.

• Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, algorithms, or underlying technology of the App.

• Interfere with or disrupt the App, its servers, or networks connected to the App.

• Use the App to harm, exploit, or deceive storefront visitors or customers.

• Exceed reasonable usage limits or use the App in a manner that places excessive load on our infrastructure.

• Resell, sublicense, or redistribute the App or any part of the Service without our prior written consent.

• Use the App to scrape, extract, or collect data for purposes unrelated to the intended functionality of the Service.

We reserve the right to suspend or terminate your access to the App at any time, without notice, for violations of these Terms or for any conduct that we, in our sole discretion, determine to be harmful to the App, its users, or third parties.

5. Intellectual Property

Our IP

The App, including all code, design, features, AI models, algorithms, documentation, and content, is the exclusive property of CMK Technologies and is protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the App.

Theme Sections and Generated Content

Theme sections, code snippets, and other content created or generated through the App for use in your Shopify store are licensed to you for use on your store(s) only. You may not resell, redistribute, or sublicense generated sections or code as standalone products.

AI-Generated Content

Content generated by the App's AI features (including analysis, suggestions, and test variants) is provided as-is. We make no representations regarding the originality, accuracy, or legal compliance of AI-generated content. You are solely responsible for reviewing, modifying, and approving all AI-generated content before publishing it on your store.

6. Disclaimer of Warranties

THE APP AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• ANY WARRANTY THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

• ANY WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF AI-GENERATED ANALYSIS, SUGGESTIONS, OR CONTENT.

• ANY WARRANTY THAT A/B TEST RESULTS WILL BE STATISTICALLY VALID, ACCURATE, OR LEAD TO IMPROVED CONVERSION RATES OR REVENUE.

• ANY WARRANTY REGARDING THE COMPATIBILITY OF THE APP WITH YOUR SHOPIFY THEME, THIRD-PARTY APPS, OR SPECIFIC STORE CONFIGURATIONS.

We do not guarantee any specific results, revenue increases, conversion improvements, or business outcomes from using the App. Past performance of A/B tests or optimizations does not guarantee future results.

AI-generated analysis and recommendations are algorithmic suggestions, not professional business, legal, marketing, or financial advice. You should exercise your own judgment before implementing any changes to your store.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CMK TECHNOLOGIES, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES.

• ANY LOSS OR DAMAGE ARISING FROM:

  • YOUR USE OF OR INABILITY TO USE THE APP.

  • ANY CHANGES MADE TO YOUR SHOPIFY THEME, STORE, OR CONTENT THROUGH THE APP.

  • A/B TEST RESULTS, WHETHER ACCURATE OR INACCURATE, AND ANY BUSINESS DECISIONS MADE BASED ON SUCH RESULTS.

  • AI-GENERATED ANALYSIS, SUGGESTIONS, CONTENT, OR RECOMMENDATIONS.

  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS.

  • ANY INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SERVICE.

  • ANY BUGS, ERRORS, OR INACCURACIES IN THE APP.

  • ACTIONS OR OMISSIONS OF THIRD PARTIES, INCLUDING SHOPIFY.

  • ANY IMPACT ON YOUR STORE'S PERFORMANCE, SPEED, SEO RANKINGS, OR CUSTOMER EXPERIENCE.

IN ANY EVENT, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APP IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY EUROS (€50), WHICHEVER IS GREATER.

THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED ITS ESSENTIAL PURPOSE.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless CMK Technologies, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of the App.

• Your breach of these Terms.

• Your violation of any applicable law or regulation.

• Content you create, publish, or test using the App, including A/B test variants.

• Any claim by a third party (including your customers or storefront visitors) related to your use of the App, your store, or your products.

• Your failure to obtain necessary consents or provide required notices related to data collection, cookies, or A/B testing on your store.

  
  

9. Theme and Store Modifications

Merchant Responsibility

The App may modify your Shopify theme files, including adding, editing, or duplicating sections, templates, and assets. You acknowledge and agree that:

• You are solely responsible for backing up your theme before using the App.

• We are not responsible for any unintended changes, conflicts, or issues caused by theme modifications, including but not limited to visual defects, broken functionality, performance degradation, or incompatibility with other apps or theme updates.

• You should test all changes in a development or preview environment before publishing to your live store.

• Uninstalling the App does not automatically remove theme modifications made during use. You are responsible for cleaning up any files or code the App added to your theme.

A/B Testing

When running A/B tests through the App:

• You are responsible for the content and claims made in all test variants, including AI-generated variants that you approve and publish.

• We do not guarantee the statistical validity of test results. Results are provided for informational purposes, and you should apply your own judgment when interpreting them.

• A/B tests may affect your store's customer experience during the testing period. You accept this risk.

• We are not liable for any negative impact on conversion rates, revenue, customer satisfaction, or any other business metric resulting from A/B tests.

10. AI Features Disclaimer

The App uses artificial intelligence to analyze pages, generate suggestions, and create A/B test variants. You acknowledge and agree that:

• AI analysis and suggestions are automated outputs, not professional advice. They may be inaccurate, incomplete, or unsuitable for your specific situation.

• AI-generated content may not comply with advertising regulations, consumer protection laws, accessibility requirements, or industry-specific rules in your jurisdiction. You are solely responsible for reviewing and ensuring compliance.

• We do not guarantee that AI suggestions will improve your store's performance.

• AI capabilities may change over time as models are updated. Feature availability and output quality may vary.

• You are the publisher of any AI-generated content you choose to deploy on your store, and you assume all responsibility for it.

11. Availability and Modifications

• We strive to provide reliable service but do not guarantee uninterrupted availability. The App may be subject to downtime for maintenance, updates, or circumstances beyond our control.

• We reserve the right to modify, update, or discontinue any feature of the App at any time, with or without notice.

• We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or by email. Continued use after changes constitutes acceptance.

  
  

12. Termination

• You may stop using the App and uninstall it at any time through the Shopify admin.

• We may suspend or terminate your access at any time, for any reason, including but not limited to violation of these Terms, non-payment, or conduct we deem harmful.

• Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) shall survive.

  
  

13. Third-Party Services

The App operates within the Shopify platform and may integrate with third-party services (including AI providers, analytics services, and cloud infrastructure). We are not responsible for the availability, accuracy, or practices of third-party services. Your use of Shopify is governed by Shopify's own terms of service.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Denmark.

Before initiating any formal legal proceedings, you agree to attempt to resolve the dispute informally by contacting us. If the dispute is not resolved within 30 days of the initial notice, either party may proceed with formal proceedings.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CMK Technologies regarding the App and supersede all prior agreements, understandings, and representations.
